TMZ reports the singer is en route to the US capitol for a hearing on the matter scheduled for Monday.
Chris was arrested in October 2013 for allegedly punching a male outside the W Hotel in the city and throwing blows with his security guard after two men attempted to photobomb a picture he was taking with fans.
Although Chris is currently charged with misdemeanour assault, prosecutors filed legal documents on Friday saying they believe there is enough evidence to support a felony prosecution, according to the outlet.
They apparently believe the alleged victim's injuries were severe enough to require hospitalisation, which could justify a felony charge if more evidence is gathered.
This would make it very likely that Chris could face jail time if found guilty.
The singer's legal troubles appear to be never-ending at the moment ' he was kicked out of a rehab facility in March after allegedly breaking rules. As being in rehab was part of the conditions of his probation, the judge overseeing his case ordered him to stay in jail until his trial for the DC case starts on April 17, something the star is said to be deeply unhappy about.
'He wants this DC case behind him but he's not trying to get his hopes up,' a source told Hollywood Life. 'He's not setting himself up for the ultimate failure. He's just playing the waiting game but he has no hopes either way because he doesn't want to be let down.'
